
Opponent Waiting for Final Vote
The West Virginia Family Foundation has decided to hold off on a court
challenge against table games in the state. They are relieved that
Jefferson County voted against the games, and are hoping that Hancock
and Kanawha Counties follow suit. However, they are disappointed that
Ohio residents voted yes.
They are awaiting the voting results for Hancock on the 30th and
Kanawha on August 11th, before deciding whether or not they will
challenge the law that made them possible in federal court. They filed
a state lawsuit on May 4th trying to stop the vote to add table games
to the existing slot machines that are at state racetracks now.
However, the State Supreme Court refused to consider the suit on May
22nd, and they will probably not try the state route again. They feel
that the court chose “revenue over the rule of law” and they are going
to wait to see the results in the other two counties. They had
originally said that if any of the counties voted yes then they would
be looking to challenge their constitutionality in federal court.
Instead of moving forward at this point, they are going to use this
time to “galvanize opposition” to the table games, so that they go to
federal court stronger than they went to state court. They said that
they have been working in Hancock County trying to get people to vote
no as their Election Day is quickly approaching.
